These terms are an agreement between FLOW FN PTE. LTD. (UEN 202617303Z), a private limited company incorporated in Singapore ("we", "us"), and the organisation that creates a kitset.io workspace ("you", "Customer"). By creating a workspace you accept them. If you are accepting on behalf of an organisation, you confirm you are authorised to do so.
1. What the service is
kitset.io is a hosted, multi-tenant application for internal operations. A workspace includes a Management Console, an Employee Portal, and whichever modules you install. We may add, change or withdraw features; we will not remove a material feature you are paying for without reasonable notice.
2. Accounts
The account that creates a workspace is its Owner and holds the billing relationship. You are responsible for your users' actions, for keeping credentials secret, and for removing access when someone leaves. We offer two-factor authentication and recommend requiring it for Console users. Tell us promptly at [email protected] if you believe an account has been compromised.
3. Trials
New workspaces get a 30-day trial with the capacity described on the pricing page. No payment card is required to start one. When a trial ends without a subscription, the workspace becomes read-only: you can still sign in, search, read and export, but you cannot create or change records. We do not delete trial data at the end of the trial — see clause 10.
4. Subscriptions, capacity and payment
Plans, capacity packs and module prices are those published at /pricing when you subscribe. Fees are stated in US dollars and exclude any tax that applies where you are; where tax is due, it is added.
Monthly subscriptions are charged in advance each month. Annual subscriptions are charged in advance for the equivalent of 10 months. Payments are processed by Stripe; we do not receive or store your card number.
Your plan sets a limit on Console users, Portal users, storage and installed modules. Exceeding a limit is prevented rather than billed for: the action that would exceed it is refused until you add capacity. Capacity added mid-term is charged pro rata.
We may change prices with at least 30 days' notice before the change applies to your next renewal. Changes never apply mid-term.
5. Non-payment
If a payment fails we will retry and notify the Owner. If the subscription remains unpaid, the workspace becomes read-only in the same way as an expired trial. We will not delete your data for non-payment without the notice described in clause 10.
6. Cancellation and refunds
You may cancel at any time from the workspace's billing settings. Cancellation takes effect at the end of the current billing period and the workspace remains fully usable until then. We do not provide refunds for partial periods, except where the law requires it or where we have materially failed to provide the service.
7. Your data
Everything you and your users put into a workspace remains yours. We claim no ownership of it and we do not use it to train models, to build products, or for advertising. We process it only to provide the service, as set out in the Privacy Policy and, where you are a controller of personal data, the Data Processing Addendum.
You are responsible for having a lawful basis to put personal data about your staff into the service, and for telling them you have done so.
8. Acceptable use
Your use must comply with the Acceptable Use Policy, which forms part of these terms. Of particular note: Systems & Access is an ownership and access register, not a password manager, and passwords, recovery codes, API keys and private keys must not be stored in it.
9. Availability and support
We aim for high availability but do not currently offer a contractual uptime commitment or service credits. Planned maintenance is announced in advance where practical. Support is by email at [email protected], with a target first response of two business days.
10. Suspension, termination and what happens to your data
We may suspend a workspace immediately where it is necessary to protect the platform or other customers — for example an active compromise, or use that threatens our mail deliverability — and will tell you why as soon as we reasonably can.
Either party may terminate for material breach that is not cured within 30 days of notice. On termination, or at your request, we will delete your workspace data within 30 days, except where we are required to keep it by law. Before deletion you can export every register, the user directory and the audit trail yourself from the Management Console; ask us at [email protected] for uploaded files.
Data in routine backups may persist for up to a further 30 days before it expires in the ordinary course.
11. Confidentiality
Each party will keep the other's non-public information confidential and use it only to perform this agreement. This does not apply to information that is public through no fault of the receiving party, was already known to it, or is independently developed.
12. Warranties and disclaimer
We warrant that we will provide the service with reasonable skill and care. Beyond that, and to the fullest extent the law allows, the service is provided "as is" without further warranty. We do not warrant that it will be uninterrupted or error-free.
kitset.io is an operational record-keeping tool. It is not legal, tax, employment or compliance advice, and using it does not by itself make you compliant with any regulation.
13. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, neither party is liable for indirect or consequential loss, or for loss of profit, revenue, goodwill or anticipated savings. Each party's total liability arising out of this agreement in any 12-month period is limited to the fees you paid in that period.
14. Changes to these terms
We may update these terms. For material changes we will give at least 30 days' notice to the Owner by email and update the date at the top of this page. Continuing to use the service after the change takes effect means you accept it.
15. Governing law
These terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction over any dispute.
